Justice Ministry highlights “historic” int’l court wins for Georgia over 2008 war

The Georgian Ministry of Justice on Thursday highlighted “historic” wins for Georgia over cases related to the 2008 war with Russia at the European Court of Human Rights and the International Criminal Court.

In a statement on an anniversary of the 2008 conflict, the Ministry noted the ECHR had confirmed that the Abkhazia and Tskhinvali (South Ossetia) regions were an integral part of Georgia and occupied by Russia.

The Russian Federation, as an occupying state, is responsible for massive violations of the rights of the ethnically Georgian citizens. In the August 2008 war case, the European Court of Human Rights ordered Russia to pay up to €130 million for the benefit of up to 24,000 Georgian citizens who suffered during the war”, the Ministry said.

It added the ICC Prosecutor had completed the investigation on a case over the war in late 2022 without identifying any violation of international law norms or any other type of misconduct by the Georgian side.

In 2022, the International Criminal Court issued arrest warrants against three “high-ranking officials” of the Tskhinvali region for crimes committed against Georgians during the August war and identified the responsibility of the late Russian general”, the statement noted.

A ruling on April 9 also said Russia was continuously carrying out the illegal ‘borderisation’ process on the territory of Georgia, violating the rights of Georgian citizens, the Ministry added.
